1. Agreement to Terms
By accessing or using any Cre8tive application or service — including Echoes, Daily Brief AI, BookBeasts, or any other Cre8tive product (collectively, the "Services") — you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Cre8tive ("we," "us," or "our").
If you do not agree to these Terms, you may not access or use the Services.
2. Eligibility
2.1 Age Requirements
You must be at least 13 years old to use our Services. Users between 13 and 18 must have permission from a parent or legal guardian, who agrees to these Terms on their behalf.
2.2 Legal Capacity
By using the Services, you represent and warrant that:
- You have the legal capacity to enter into these Terms
- You are not prohibited from using the Services under applicable law
- All information you provide is accurate, current, and complete
3. Accounts & Registration
To access certain features of our Services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
4. Use of Services
4.1 Permitted Use
You may use our Services for lawful, personal, non-commercial purposes in accordance with these Terms.
4.2 Prohibited Activities
You agree not to:
- Use the Services for any unlawful purpose or in violation of any regulations
- Attempt to gain unauthorized access to any portion of the Services or related systems
- Reverse engineer, decompile, or disassemble any part of the Services
- Use any automated tool, bot, or scraper to access the Services
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or any other malicious code
- Create voice clones of individuals without their explicit consent
- Use voice clones for deceptive, fraudulent, or harmful purposes
5. User Content & Voice Data
5.1 Your Content
You retain ownership of any content you submit to our Services, including voice recordings. By submitting content, you grant Cre8tive a limited, non-exclusive license to use, store, and process that content solely to provide the Services to you.
5.2 Voice Recordings — Consent Requirement
When using Echoes or any voice cloning feature, you confirm that:
- You have obtained explicit consent from any person whose voice you are cloning
- The voice clone will only be used for lawful, personal purposes within the app
- You will not use a voice clone to impersonate, deceive, or harm any individual
Cre8tive takes misuse of voice technology seriously. Violations may result in immediate account termination and may be referred to relevant authorities.
5.3 Content Removal
We reserve the right to remove any content that violates these Terms or our policies, without prior notice.
6. Intellectual Property
The Services, including all software, design, text, graphics, logos, and other content created by Cre8tive, are owned by Cre8tive and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of any Cre8tive content without our prior written consent.
7. Subscriptions & Payments
7.1 Paid Plans
Certain features require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase.
7.2 Billing
Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method on file for recurring subscription fees.
7.3 Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by law.
7.4 Price Changes
We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price changes.
8. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms.
Upon termination, your right to use the Services will immediately cease. You may request deletion of your account and associated data by contacting us at cre8tiveapps.inc@gmail.com.
9. Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Cre8tive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.
Our total liability to you for any claims arising from these Terms or the Services shall not exceed the amount you paid to Cre8tive in the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
